Judges must use the law not bribe to decide this case

Companies Commission of Malaysia (CCM) assistant registrar Roslizawati Nur Wahida Abd Ahmad, 36, said Mohamad Salleh and his son Wan Shahinur Izran, 30, were appointed as directors of Syarikat Macronial Technology Sdn Bhd when the first directors, Sumami Kiman and Saharuddin Abdullah resigned on August 28, 2006.
During examination in chief by deputy public prosecutor Mohamad Azies Han Mohd Fadzil on the first day of Mohamad Salleh's RM49.7 million criminal breach of trust (CBT) trial, she said all the relevant information were stated in Borang 49.
Mohamad Salleh is accused on one count of misappropriating RM9,758,140 through four cheques to partly finance the purchase of two units of One Menerung condominium at BI-1 and B1-2, in Kuala Lumpur.
He allegedly committed the offence between December 1 and December 4, 2009 at CIMB Islamic Bank Bhd, Jalan Burhanuddin Helmi in Taman Tun Dr Ismail.
He is accused on the second count of transferring RM40 million, through a cheque, into the account of National Meat & Livestock Corporation Sdn Bhd of which he and one of his children were the owners, at the same bank between May 6 and November 16, 2009.
Both charges are framed under Section 409 of the Penal Code, which carries a maximum jail term of 20 years and whipping, and liable to a fine upon conviction.
Roslizawati who is also the prosecution's first witness said Mohamad Salleh's daughter Wan Izzana Fatimah Zabedah, 24, was appointed as director of Syarikat Real Food Company Sdn Bhd on May 20, 2009.
"On January 6, 2010, the directors of Syarikat Real Food Company were Mohamad Salleh, Wan Izzana Fatimah Zabedah, Wan Shahinur Izran and new appointment Wan Shahinur Izmir," she said.
Roslizawati said Wan Shaninur Izran and Wan Shahizur Izmer were also appointed as Syarikat Bizvance Sdn Bhd directors on August 21, 2006 after its directors Sumami and Saharuddin resigned the same day.
She said, however, that on April 23, 2008, Wan Shahinur Izmir resigned as Syarikat Bizvanve director and was replaced by Mohamad Salleh.
When proceedings resumed this afternoon, deputy public prosecutor Awang Armadajaya Awang Mahmud applied for an adjournment, telling the court that the defence had received a letter from the High Court that Mohamad Salleh's appeal against a Sessions Court decision to reject his application to strike out the charges had been fixed for case management on June 26.
"During the case management the prosecution will apply for the appeal to be heard, if possible early July.
"If it (decision) is in our favour, the trial will proceed in July," he said.
Judge Norsharidah Awang granted the application and set July 16 for the next hearing date. – Bernama, June 23, 2014.
