Business plans in the corporate sector are undertaken by the CEO on a yearly basis so that revenue will always be ahead of costs. New opportunities are pursued, marketing plans are executed and senior managers are fully geared towards meeting the set targets.

Only in this structured manner can the key objectives of any business plan be achieved.

But while this may sound easy, many CEOs will say it is not as straightforward to implement.

Still, a business plan must be formulated, prepared and executed. It does not matter that it is not the best. Better to have one than none at all.

Without it, a firm operates on an ad hoc basis, opens itself to volatile market forces, has no strategy to fight off its competitors and would likely be unable to price its products or services according to market demand, share and position.

The wrong pricing mechanism and strategy will directly affect sales revenue and, ultimately, your bottom line.

Managing a country may be different, but the basic fundamentals remain the same.

Think of a government as a corporate entity with the prime minister as its CEO.

The CEO must have a business plan every year in order to:

• generate sufficient revenue (income) from all forms of taxes, including corporate taxes and individual;
• be aware of cost elements both in terms of production and human resources;
• be successful in servicing market demand (clients or voters) and market share; and
• be aware of new market opportunities (projects and FDIs) that will generate new income and employment opportunities in order to expand the market base (more clients or voters).

The Pakatan Harapan (PH) government obviously did not have a business plan for the country. The leaders of the coalition did not demand such a plan from their CEO.

Not having a business plan meant the CEO was left to his own devices with no clear direction.

PH’s CEO operated by his own ideas, managed the country on an ad hoc basis, brought in irrelevant projects (think third national car) not demanded by its clients, and lost market focus.

PH was confused between its own clients and that of its competitors, and priced its services either too cheaply or too high.

Eventually, it lost its market position and collapsed.

Perikatan Nasional (PN) could learn from the failure of PH.

So far, though, PN has failed to plan. This is likely due to the Covid-19 pandemic, but that is no reason for not formulating a plan – one that would secure its market share within the sphere of its client base.

This is crucial as PN is a new, unproven brand of service with no established brand loyalty.

Its current market position is not stable and widely open to competition.

PN is also derived from old brands that matured over the years, showing a decline in sales and loss-making strategies which the market had rejected before.

The board of directors in PN should demand a more creative business plan from the CEO for the purpose of setting the right targets and objectives.

Board members and senior staff holding various positions do not guarantee sales and revenue.

Be warned: the lack of a viable business plan will likely result in the replacement of the CEO and possibly a change in shareholders too.

In 2016, Mahathir resigned from UMNO Baru because he no longer could control the party. The dog Mahathir trained did not want to obey him.

In September 2016, Mahathir formed another party by the name of Pribumi Bersatu.

Again he divided the party into 2 camps.

Today Mahathir's own party Pribumi Bersatu has kicked him out together with his own son.

BOUSTEAD : The greed and corruption continues!

Khaled Nordin appointed Boustead Chairman, and it looks like some UMNO cronies knew about it much earlier, and made some moves to earn a windfall.

What was initially going to be a profit for the government, has become a profit for selected individuals who had this insider info, because the shares owned by the government were cynically sold off to these UMNO kakis.

It’s hard to detect because the trades happened in the stock market. But for those not familiar, this is how it works:

GLCs are controlled by the government by way of holding a substantial percentage of shares. For example in Boustead’s case, Urusharta Jamaah, a government vehicle, prior to 13 April 2020 owned 18,539,967 units of shares in Boustead.

A cynical and planned sell-off began around the 13th of April. Quietly, of course, so that the shares disposed of by the government will be picked up by cronies who are on standby, instead of being swallowed up by the open market.

A total of about 1.5 million shares Urusharta Jamaah owns in Boustead were cynically disposed of, then suspectedly picked up by UMNO cronies.

13 April: 118,000 units disposed (0.72)
14 April: 209,800 units disposed
15 April: 349,900 units disposed
16 April: 329,500 units disposed (0.71)
17 April: 180,900 units disposed (0.685)
21 April: 134,900 units disposed (0.66)
22 April: 30,800 units disposed (0.64)
23 April: 53,400 units disposed
24 April: 125,500 units disposed
27 April: The day people started suspecting something is brewing (0.57)
28 April: Price jumped to (0.615)
29 April: Price jumped to (0.685)
30 April: Price jumped to (0.725), and Khaled Nordin announced new Chairman

As you can see, the price of Boustead’s shares steadily plummeted since 13 April 2020. It didn’t really set off any alarm bells because the volume was quite low. The amount sold was just enough to not set off alarm bells. So not many normal traders noticed, and even if they did they wouldn’t be paying attention.

But UMNO cronies who knew Khaled Nordin was about to be appointed knew what was going to happen. They acquired all these shares disposed of by the government, cheaper and cheaper day by day.

And when Patriot questioned the sell-off on the 27th of April, immediately the sell-off stopped the next day. And on the 28th the price of Boustead’s stocks jumped.

By this time, about 1.5 million were already disposed of by the government and picked up by UMNO kakis.

Maybe if PATRIOT didn’t expose this, the sell-off would have continued and more shares would be picked up by the UMNO cronies. Maybe.

So after PATRIOT’s exposé on the 27th and Boustead’s lame denial that same evening, the sell-off immediately stopped. On 28th the price started rebounding and on 30 April after Bursa was closed, Khaled Nordin was announced the new Chairman.

This means the UMNO cronies who picked up the shares disposed of by Urusharta Jamaah since 13 April are going to receive their money soon. The Boustead shares they purchased cheaply for the past two weeks are going to be worth much more.

This also means that if PATRIOT did not make the exposé, more shares would have been disposed of by the government, more shares will be picked up cheaply by UMNO kakis, Khaled Nordin’s appointment is announced much later and the UMNO kakis would have made much more money doing insider trading.

Well, this is how it’s been done all these while. What was a profit for the government that was for the country, in the end, became profit for selected cronies.

Dr Hamimah Idruss, became the first individual to be convicted on eight charges involving RM41.3 million under the Anti-Money Laundering Act 2001 and was sentened to 38 years in jail and fined RM6,394,530.72 after being found guilty by the Sessions Court here today.

Hamimah, 64, a former director of Syarikat Safire Pharmaceuticals (M) Sdn Bhd, was charged under Section 4(1) of Anti-Money Laundering Act 2001 for receiving RM41.33 million in illegal gains between June 3 and 10, 2003, which provides for a fine of up to RM5 million or five years maximum imprisonment or both.

She also faced 10 counts of abetting with her staff Yusaini Wan Abi Sabian, 42, to falsifying 10 agreements under Safire Pharmaceuticals worth US$1.2 million (RM4.56 million) each, under Section 109 of the Penal Code.

Riza Aziz case settlement: US$108m asset forfeiture is on top of Red Granite payout

KUALA LUMPUR (May 17): The US$108 million assets owned by Riza Aziz allegedly financed using 1MDB funds that the Malaysian government expects to recover, is on top of the US$57 million obtained by the US authorities from Red Granite Pictures, says Attorney General Tan Sri Idrus Harun. 

The assets comprise properties in the US and the UK, as well as cash and a 93-year-old poster from a 1927 silent movie, Idrus said in a statement today.

He said the letter of representation by Riza’s lawyers from Messrs Scivetti & Associates dated Nov 18, 2019 underlined that Riza will surrender his rights in three properties seized by the US Department of Justice and return the assets or its value to the Malaysian government. 

However, the three properties in question have already been seized by the US authorities previously, and it is understood that proceeds of the asset sale will be returned to Malaysia by the US Department of Justice.

This raises the question as to why Malaysian prosecution had to arrive at a settlement with Riza this week.

As recently as August 2019, it was reported that US prosecutors were seeking to sell the homes, as it requested a California court to lift a stay on forfeiture proceedings so that the properties can be sold.

Riza was granted a discharge not amounting to acquittal (DNAA) at the Sessions Court on five counts of money laundering involving US$248 million of 1MDB funds, following letters of representation by Riza’s lawyers and an application by the prosecution for the DNAA.

Idrus, in his statement today, said that on top of the three assets — a Beverly Hills bungalow, a New York apartment, and a town house in London — the MACC had on April 21 this year also sought another asset from Riza.

This consists of a one-frame, three-sheet colour lithograph poster created by the German artist Heinz Schulz Neudamm for the 1927 silent film “Metropolis”.

On top of that, the MACC had also instructed Riza to surrender US$14.09 million held in an escrow account at Huntington National Bank in the US, the attorney general said.

The three properties, the Metropolis poster and the escrow account cash sum up to an estimated US$108 million (excluding associated costs), which will be credited into the “1MDB Asset Recovery Trust Account”, said Idrus. 

“This is in addition to the US$57.03 million which was forfeited earlier in April 2019 from Red Granite Pictures, a company co-owned by Riza Aziz, the funds of which are traceable to 1MDB,” he said.

The forfeiture of Riza’s assets is part of a deal struck with the prosecution which resulted in the court granting the DNAA last week.

Idrus said that under the deal, Riza is required to pay a compound pursuant to Section 92 of the Anti-Money Laundering and Anti-Terrorism Financing Act 2001 (AMLA Act) on top of the asset forfeiture.

Riza was charged with the five counts of money laundering under Section 4(1)(a) of the AMLA Act, each carrying a punishment of five years in jail, or a fine not less than five times the illicit funds involved or RM5 million, whichever is higher.

Riza’s charges entail a fine of at least five times US$248 million, being the sum involved. However, under Section 92, the authorities may accept a compound of anywhere below 50% of the maximum fine. 

The arrangements for asset forfeiture, said Idrus, are part of the government’s ongoing efforts to recover assets related to 1MDB.

“I have been informed that negotiations with several parties in the past year, especially in relation to assets located overseas, had resulted in the successful recovery and repatriation of monies which will reduce the government’s burden in repaying 1MDB’s debts,” said Idrus.

“Such negotiations have been complex, requiring close cooperation with authorities abroad, and are continuing,” he added.

I took into account the benefits of the AMLA Act 2001 when I decided to charge Riza Aziz in July 2019 with 5 money laundering offences punishable under Section 4(1) of that Act for receiving proceeds of unlawful activities, between April 2011 and November 2012, totalling USD248 million of monies belonging to 1MDB. I was satisfied that the prosecution had a very strong case to establish the ingredients of the offences. The documentary trail was substantial and highly credible. Upon conviction, the prosecution would have invited the trial judge to impose a sentence commensurate with the severity of the offences, the maximum being 15 years for each charge. But more significantly, the criminal court is given power by Parliament to additionally impose a penalty up to 5 times the amount involved in the unlawful activities, that is 5 times USD248 million, which would work out to some USD1.2 billion. We would have sought this sum upon his conviction.
 
3. As Public Prosecutor, I personally decided to prosecute about 25 cases. In each of these cases, I was briefed by MACC or the police and DPPs. I probed deeply. My decision-making process took time. From my trial experience, evidence gathering continues from initiation of proceedings until completion of trial. Only when I was satisfied that the prosecution could secure a conviction, did I make the decision to prosecute. It was always a deliberate and properly analysed decision. That same rigour was brought to the decision to prosecute Riza. In none of these 25 odd cases, did I consider favourably a request by any accused to settle on such terribly poor terms to the prosecution. That would have called into question the wisdom and integrity of my decision to prosecute in the first place.
 
4. In paragraph 2 of Tan Sri Idrus’s media release, reference is made to a minute I made on 19 November 2019 to Datuk Seri Gopal Sri Ram on the letter dated 18 November 2019 from Riza’s solicitors. That indeed was my style. After having read that letter, I wrote a couple of words or sentences to him. I have no access to the original letter with my handwriting. Because of this handicap, I cannot comment on it.
 
5. What is abundantly clear is that I did not make any decision in relation to Riza’s representation up to the date of my resignation, 28 February 2020. A decision of this importance involving billions of ringgit and significant public interest would be made by me in writing. I did not, and none exist.
 
6. With regard to communications with the 2 major actors, my successor and Datuk Seri Gopal Sri Ram, the position is as follows. I have not communicated with Tan Sri Idrus since 28 February 2020. This is not unusual. I did not communicate with my predecessor during my tenure. I spoke on a couple of occasions with Datuk Seri Gopal Sri Ram over the telephone between 28 February and 14 May 2020, but this subject was never raised by him. Hence after my resignation, I was kept in the dark on this and all other matters.
 
7. In Paragraph 3 of the media release, Tan Sri Idrus states that “Malaysia is expected to recover approximately USD108 million”. With the greatest of respect, this is a red herring. By personal diplomacy, we established strong relations with DOJ after I took office. They have returned billions of ringgit, and more monies may be released in future by DOJ. The purpose of prosecuting Riza was not to strengthen our chances of securing monies from DOJ. DOJ would have returned these monies in any event because it belongs to Malaysia and was stolen from Malaysia. Riza is not offering to pay any new money or monies from any source other than DOJ seized assets. The USD108 million, would in any event be returned by DOJ to Malaysia. Thus, Riza is unnecessarily getting credit for returning monies that are not his. Hence, it is a sweetheart deal for Riza but terrible for Malaysia.
 
8. Finally, even the timing of Riza’s DNAA is bizarre. In both civil and criminal proceedings which proceed to trial, a plaintiff or the prosecution loses substantial leverage over the adverse party if it withdraws court proceeding before the terms of settlement are completely performed. This is elementary. Hence, one needs to question why Riza has been given a DNAA so prematurely.
 
9. Since Tan Sri Idrus is at pains to emphasize the weight he gave to my so called ‘agreement in principle’ (which itself is a fiction), let me state publicly that I would have never sanctioned this deal. I would have lost all credibility in the eyes of the people of Malaysia whom I endeavoured to serve as public prosecutor to the best of my ability, honestly and professionally if I had approved it. I would have betrayed the trust the Prime Minister and the PH government had reposed in me.
